Texas honor student jailed for missing too much school


An honor student in Texas was thrown in jail after she missed too many classes at her high school.

A judge issued Diane Tran, 17, a summons Wednesday for her excessive truancy after she missed class. She was arrested in open court.

Last month, Tran was issued a warning by the judge for missing school.

Tran said she works both full-time and part-time jobs, in addition to taking advanced and college level courses.

But the judge said Tran's case was bigger than the individual situation of one student.

"If you let one run loose, what are you gonna' do with the rest of 'em?," said Judge Lanny Moriarty. "Let them go too? A little stay in the jail for one night is not a death sentence."

But Tran's classmates said she had a lot more to juggle than the average teen.

"She goes from job to job from school. She stays up until 7 a.m. in the morning doing her homework," said Devin Hill, a classmate and co-worker.

On top of that, Tran said her parents spilt up and moved away, leaving her to support her younger sister.

The judge admitted that he wanted to make an example of the teen.

Tran had to spend 24 hours in jail and had to pay a $100 fine.

  1. This world is becoming or, should I say is, certifiably insane. This girl's circumstances should have been taken into account obviously. The justice system is not there for the benefit of people. It is there to assert its authority. Tran should be compensated big time for this atrocity.

      The judge is correct. The case has nothing to do with Tran. It is about commerce and high school children are the most convenient prisoners because they are not hardened, they are easily dominated and controllable. Prisons full of high school kids will require less guards, less infrastructural investment and when they are institutionalized, they become repeat customers as ex-con.

    3. In our suburban Chicago public schools in the 60's, the teachers stated every year "Your attendance is importance because, and only because, state dollars are based on attendance. I don't care about your attendance, but my boss sure does.". The wording varied slightly but the message was blunt and clear. And this was before Jimmy Carter and the federal Dept of Education. As Chicago kids we knew how corrupt *everything* was, and how dangerous it was to speak up. Digusting? YES. Outrageous? YES. But you don't like it, don't even think about fighting it, just leave the corrupt city. As responsible parents, it is child abuse to leave our children in the hands of these insane and evil people.

    7. She has NO business working two jobs and taking care of her sister. She should be unemployed like everybody else and that sister should be in foster care so she can be molested, raped and beaten like the rest of the foster kids.

Especially in her case, as the world becomes a harder and more unjust place, you would think those that are doing what they can to survive at that age, would be able to seek refuge in the justice system.     10. As a teacher I can tell you that the judge was right. She's Asian and these Asian kids just won't get with the program. We work hard to dumb down the kids, eradicate their morals and break their spirit so they don't question authority.

      But the Asians insist on being smart. They always have their hands up to answer questions and their high test scores make it impossible curve grades for the rest of the class.

      We don't have these problems with the white or black kids. But these Asians have a work ethic, morals and a success motivation. So what can you do but toss them in jail. They gotta get with the program.

    Uh, no. You make a JUDGMENT. It's your JOB as a judge to weigh the case and if special circumstances are present, you can let her go. Does working TWO jobs, caring for a younger sibling, and being an HONOR STUDENT not qualify as special circumstances? No one expects you to let go of some truant thug. But this girl IS extraordinary and should be treated as such.

      He's a Republican, judicial elections are partisan in Texas, and Montgomery County went Republican by close to 80% in the 2008 elections.

      There is no chance, at all, that he will be defeated by a Democratic challenger. And I really doubt the Montgomery County Republican party will let him be successfully primary challenged.

      He'll get some angry mail and then this will blow over and he'll still be a judge.

  11. Why did she have to go before a judge?? School is not required after the age of 16. Exactly what crime was she thrown in jail for?? Normally there are natural consequences for things... miss school and your grades suffer. She's an honor student! Her schooling is no longer compulsory. Is this judge for real? Cracker jacked!

  30. This so called "judge", should be sent to jail for fraudulently portraying a role of someone who has the aptitude of being able to "judge" anyone. This beautiful hearted young lady has had to "grow up" before her time through NO fault of her own making. This young teens actions of love for raising her sister while holding a full time job as well as a few part time jobs brought tears to my eyes. May God bless this child and may she know that she is held in high esteem in my heart.

    This girl had a private contract to support her sister, that supersedes her contract with the school which has a contract for attendance so many days out of the school year.

    The girl has two encumbrances and one is superior to the other.
    The encumbrance to support her sister is superior to the one created with the school.

    Needless to say, she got a lesson from the school of hard knocks and she should second guess that 'free' education. It cost her a day of her life, and $100 and public humiliation.

    The judge's comment reminded me of Hopper's comment in the Dreamworks movie Antz "You let one ant stand up to us, and they all might stand up! " (it's out of context because the entire dialogue leads to another meaning, but this part of that quote stood out for me).

    A judge judges.
    He has no connection to anyone that shows up.
    Seems she had a prior agreement with the court to go to school and not miss more days.

    Something is not being said here, but she sure has a lot of 'contracts for performance'(where she failed to perform the obligations of the contracts she entered into), but at least kept up with the one to take care of her sister.

Schools are little more than prisons and day care centers full of police with tasers who love to harass and intimidate the kids. The school boards love to harass parents as does clearly the so called judicial system. The system needs to learn that WE DO NOT NEED MICROMANAGED. I hope this so called Judge is fired and made a laughing stock. Clearly he lives in the dark ages with his head up the ass of some bureaucrat. Instead of putting this poor girl in jail or fining her why didn't he serve the people in this case her, by figuring out a way to lessen her burdens instead of adding to them. Maybe it is also a racial thing maybe he does not like aisians or anyone other than white people. Texas is well known for it's harassment of anyone who is not white. How could this ruling do anything but enrage all who read it?!He should have commended her on all her hard work and efforts - she's an honor student who is taking college classes. I left Texas because the police and judges treated everybody like their own personal ATMs. They routinely arrest kids at school without the benefit of their parent's presence and then drag them to court. TEXAS HAS BECOME A FASCIST ENTITY. What is going on there is one gigantic criminal enterprise.   59. This is true. My 17 year old brother spent 2 days in jail and family paid thousands of dollars in fines for truancy. The judge flat out told another mother in court 'We just want your money.' He ended up dropping out and getting his GED, while many other kids dropped out and will never finish their education. Look up Judge Lujan's track record and the apparent pride he takes in locking up teenagers and fining parents who don't have the means to pay.

What a stupid Judge he handed the Student a Criminal record damaging her chances for employment - Taking days of is supposed to handled by the Education board This Judge did not give the Student a fair Trial as he admitted that he was influenced by the reaction of others = This is hear say prejudice and discriminatory He should be sued and struck off Tried and I recommend a long Prison sentence so as not to influence other Judges and all the students from all Colleges should take days of in protest they should sit outside the Judges House - As for the guy defending her he should ashamed calling himself a a lawyer does not know the LAW
